Farming agreement

Question:

Slms mufti saab. Hope you doing well

Lets say I am into the business of farming. Now I have employed someone. We have an agreement that I will not pay him any salary but he will be paid according to the harvest we get from farming from this season.

The agreement is such that if we manage to harvest 100 bags of maize I will give u 5% of the bags harvested. And if we manage to harvest more like 125 than I will give a bigger % of maize bags like 10%

It’s like to say the more bags you harvest for me the more bags I will give u in return for your work

All are mine; Land seeds tools are mine. Effort will be his as he is taking care of the land.

Is such type of an agreement allowed?

Answer:

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

The arrangement in reference is permissible. [1] The condition of giving him 5% of the produce if he harvests up to 100 bags [1-100] will also be permissible. It is also permissible to stipulate that he will receive 10% of the produce for whatever is harvested above 100 bags. This should clearly be agreed and not left ambiguous.

 (قَوْلُهُ فَهَذِهِ الثَّلَاثَةُ جَائِزَةٌ) ؛ لِأَنَّ مَنْ جَوَّزَهَا إنَّمَا جَوَّزَهَا عَلَى أَنَّهَا إجَارَةٌ، فَفِي الْأُولَى يَكُونُ رَبُّ الْبَذْرِ وَالْأَرْضِ مُسْتَأْجِرًا لِلْفَاعِلِ وَبَقَرُهُ تَبَعًا لَهُ لِاتِّحَادِ الْمَنْفَعَةِ؛ لِأَنَّ الْبَقَرَ آلَةٌ لَهُ؛ كَمَنْ اسْتَأْجَرَ خَيَّاطًا لِيَخِيطَ لَهُ بِإِبْرَتِهِ، وَفِي الثَّانِيَةِ يَكُونُ رَبُّ الْبَذْرِ مُسْتَأْجِرًا لِلْأَرْضِ بِأَجْرٍ مَعْلُومٍ مِنْ الْخَارِجِ، فَتَجُوزُ كَاسْتِئْجَارِهَا بِدَرَاهِمَ فِي الذِّمَّةِ وَفِي الثَّالِثَةِ يَكُونُ مُسْتَأْجِرًا لِلْعَامِلِ وَحْدَهُ. وَالْأَصْلُ فِيهَا أَنَّ صَاحِبَ الْبَذْرِ هُوَ الْمُسْتَأْجِرُ،
