Question:
Is it allowed to give services without agreeing a price? For example I give xyz the job to do a permit for me( btw that’s his job as an agent) When I ask him the rate or price of his services,he says will see when it finishes. And lo and behold when the job is done he charges such exorbitant rate ( other agents are half his rate) What is the ruling here? This issue has become very common and people need to understand!!! Answer:
In the Name of Allah, the Most Gracious, the Most Merciful.
As-salamu ‘alaykum wa-rahmatullahi wa-barakatuh.
In principle, the fee payable in any transaction should be agreed upon and clearly determined by the parties before the transaction is entered into. A transaction in which the fee has not been stipulated or sufficiently determined is considered fāsid (defective/irregular).
It is therefore not permissible to state, for example, “I will tell you the fee after the work has been completed” or “will see when it finishes.” This is because Ijārah (a contract for the provision of a service) requires the remuneration to be known and determined by the contracting parties. The terms of the agreement should be sufficiently clear to avoid ambiguity that could potentially lead to a dispute.
If the work has already been completed without the fee having been stipulated as described, the agent cannot subsequently impose an amount of his own choosing. Rather, the remuneration should be determined according to Ujrat al-Mithl (the customary and reasonable remuneration ordinarily charged for a comparable service under similar circumstances/fair market wage). Accordingly, the agent is entitled only to Ujrat al-Mithl. [1]

الوكالة بأجر: تصح الوكالة بأجر، وبغير أجر، لأن النبي ﷺ كان يبعث عماله لقبض الصدقات، ويجعل لهم عمولة (١). فإذا تمت الوكالة بأجر، لزم العقد، ويكون للوكيل حكم الأجير، أي أنه يلزم الوكيل بتنفيذ العمل، وليس له التخلي عنه بدون عذر يبيح له ذلك، وإذا لم يذكر الأجر صراحة حكم العرف: فإن كانت مأجورة عادة كتوكيل المحامين وسماسرة البيع والشراء، لزم أجر المثل، ويدفعه أحد العاقدين بحسب العرف. وإن كانت غير مأجورة عرفًا، كانت مجانًا، أو تبرعًا، عملًا بالأصل في الوكالات: وهو أن تكون بغير أجر على سبيل التعاون في الخير. وهذا النوع لا يلزم فيه المضي في العمل، بل للوكيل التخلي عنه في أي وقت. وهذا مذهب الحنفية والمالكية والحنابلة

اعلم أن الإجارة تفسد بالشروط كما يفسد البيع، وكل جهالة تفسد البيع تفسد الإجارة من جهالة المعقود عليه أو الأجرة أو المدة؛ لما عرف أن الجهالة مفضية إلى المنازعة. والأصل قوله -عليه الصلاة والسلام-: «من استأجر أجيرًا فليعلمه أجره». شرط أن تكون الأجرة معلومة كما شرطه في البيع.
